Mandatory arbitration clauses have become pervasive and though arbitration, as a process, is derided for its opaqueness and lack of transparency, the use of mandatory arbitration continues to proliferate. According to the Economic Policy Institute’s study, “The Growing Use of Mandatory Arbitration,” approximately 60 million U.S. employees are subject to mandatory arbitration provisions and more than half, 53.9%, of nonunion employers have mandatory arbitration procedures.

Research from both the Economic Policy Institute and the Center for Immigration Studies (CIS) shows that employers pay H-2B less than Americans when performing the same jobs. This leads to depressed wages for U.S. workers competing for these same jobs in the same geographic area. Many of those shut out of jobs or experiencing wage depression are less educated, less skilled Americans who are already marginalized. The availability of H-2B workers ensures that it remains difficult for these Americans to find work at sufficient wages; rising wages are the key to returning more Americans to the labor force.

According to the Economic Policy Institute, between 2010 and 2018, low-wage workers in states with higher minimum wages saw their pay increase almost twice as fast on average as those in states that use the federal minimum. (The difference was even greater for women.)

The minimum wage has gone up in 22 states, and according to the Economic Policy Institute, 7 million low-wage employees affected by the increases will earn an extra $8.2 billion over the course of this year as a result of the changes.

The Raise the Wage Act (H.R. 582/S. 150) was introduced in January 2019 by Rep. Bobby Scott (D-Va.) and White House hopeful Sen. Bernie Sanders (I-Vt.). An analysis from the Economic Policy Institute found that the legislation, which would raise the federal minimum wage over five years, could increase the incomes and improve the lives of an estimated 40 million Americans.
